The State authorities, for the purposes of this commentary, are as follows:

• Courts
• State Prosecutors´ Departments
• Ministries
• Notaries
• Executors
• ČNB (Czech National Bank)
• Other authorities entitled by the power of law to receive information from the SCP.

The information items from the SCP registers are provided to the above authorities free of charge. By the power of law, the provider of information is entitled to the recovery of factual expenses connected with the establishment, processing, and sending out of the information items to the applicants. The amount of the recovery of factual expenses has been determined in a lump-sum figure and placed in the Tariff table relating to the way and manner of filing the request.

Ways of Filing Request:

a) Standard Way – standard provision of services by electronic way through the Information Portal of the Prague Securities Centre — Information Service Broker
As for the applicants who will sign a contract with the SCP on the uses of the ISB and will be assigned rights to the access to the data through the mentioned web portal, the recovery of factual expenses connected with the provision of the information shall be determined with respect to the necessary expenses made for the creation, maintenance, and operation of the ISB system.

b) Non-Standard Way — based on a written request for information
The applicants who will ask for information by written requests, in consequence of which the SCP shall send in writing the results relating to the requests to the applicants´ addresses, shall be charged with the repayment of factual expenses.

Ad Item 1. Current Information from SCP Register

Such information items are connected with the finding out of the account number and with the information on the state of the account by the current date. In order that the service can be carried out successfully, the applicant has to give the identification number of the concrete subject. In natural persons, it is the birth number, in legal persons it is the Identification Number (IČ) of the organization according to the extract from the Commercial Register. If the identification number is not stated, the service cannot be carried out. If the identification number is given in a non-prescribed scope, the system indicates a failure. If a wrong birth number or Identification Number (IČ) of the organization is given, i.e., a number corresponding to the parameters of the identification number yet relating to another person, the system shall carry out and charge the service. A repeated service shall also be charged.

Ad Item 2. Archive Information Asked For by Non-Standard Way

The above requests are filed in writing by a person who either has not concluded with the SCP a contract on the uses of the ISB, or has concluded such a contract and is asking for information that cannot be received through the ISB. There are lots of possibilities and combinations of requests filed by authorized persons. What may be requested for is, for example, the monitoring of accounts in a concrete period, by the dates of transfers or moves of securities from the accounts. In that way, any moves of securities in the accounts can be traced, i.e., changes in numbers of securities, ISIN of issues, changes thereof, cancellation, etc. The information shall only be provided to the entitled State authorities in the scope set down by law. The result of the service reflects the number of the subjects which the service has been requested for. The payment is calculated with respect to the number of the periods contained in the response. In case that it is the archive files output that makes parts of the response, attached to the response is the description of the archive file and, if possible, also the description of the services, which shall all be forwarded to the applicant, i.e., all kind of information that may help the applicant make an analysis of the state of the accounts under review. The information items asked for are handed over either in printed form or on technical data carriers.

Ad Item 3. Archive Information Asked For by Standard Way through ISB

This group includes precisely specified services for the individual groups of users of the web portal. In case of notaries – judicial commissioners authorized by the respective court to handle concrete inheritance – the following information items may be acquired:

• on the right of pledge by a fixed date
• extracts from pledge register and suspension of exercise of rights to dispose of pledged securities (PPN, in Czech) by a fixed date
• statement of account of a securities owner by a fixed date, including pledges and PPN
• statement of an owner account by a fixed date without pledges and PPN
• statement of history of changes in registration data of an account owner.

Ad Item 4. Periodical Information According to Specific Requirements of ČNB

Such information items are provided in the form and scope agreed upon in advance. The handing over thereof is governed by a concrete arrangement made between the SCP and the ČNB (Czech National Bank).

Ad Item 5. Copies of Documents Asked For

The matter is relating to the copies of written documents from the archives. The SCP gets them, on the one hand, from its own archives, and on the other, from the archives of contract partners. The payment of the factual expenses for a page of the documents copied shall also include, in case the documents were asked for by correspondence, the refund of postage expenses covered by the SCP for getting the information, and of the postage paid for the sending off the documentation to the applicant.

Ad Item 6. Specific Services

The matter is relating to specific requirements which, due to the character and scope thereof, cannot be included into items 1 up to 5. The processing of such requirements is not fully automated and needs additional co-operation by the SCP staff.
